<p>Whenever the power of sale clause governs over the sale of foreclosed homes in Oregon, the deployment of non-Judicial Foreclosure provisions are also employed. <p>My fiance and I each own a home.  We live in Michigan and plan to marry this summer.  His home could possibly sell for 135,000 and he owes about 180,000.  My home we could sell for what I owe on it.  What are our options?  let his go into foreclosure, try short sale, take the loss on his or sell mine and hope the market comes back?  We don&#039;t plan on staying in either home past 5 years.  We want to either build or find something more suitable for 5 kids and us&#8230;  Thanks for any advice you can give.</p>

<p>If you are looking to buy real estate in Bend Oregon I would now recommend Short Sales. When this article was written in 2009 short sales were a virtual can of worms.</p>
<p>One major problem was that you had to wait months before you would even know if your offer was approved by the bank. The bank had to approve a short sale because the seller owes<span id="more-246"></span> the bank more than the sales price of the property. The bank takes the loss in this situation. Now they are closing much quicker.</p>
<p>Here&#8217;s a story from the original article:</p>
<p>&#8220;I am currently working on a short sale that is my listing. The lender is Washington Mutual which was bought out by Chase during my marketing of this particular property. The first offer that was accepted by my clients and awaiting bank approval was on December 17, 2008. There were two back up offers. This party withdrew their offer 40 days later without hearing from the lender.</p>
<p>Then another back up offer was submitted to the bank. During this period 2 other offers came in. Both offers were substantially higher that the previous offers. The best offer was then submitted to the lender on February 25, 2009. One month and 6 days later the lender sent an e-mail to me stating that the offer was approved by them and that I should receive an approval letter within 7 business days. I am not holding my breath on that one!</p>
<p>My son and partner Matt Johnson made an offer on behalf of one of his clients. At the time there were a total of five offers. A few of these were good offers. The buyers and brokers waited about 6 weeks to find out that the lender did not approve any of them and proceeded to foreclose on the property.</p>
<p>There are only a small percentage of these real estate sales that eventually close. One reason is that the seller must prove there is a &#8220;hardship&#8221; and they don&#8217;t have the ability to make the payments. Most lenders won&#8217;t even consider a short sale until the owner is behind in their payments. Just because the owner owes more than the property is worth doesn&#8217;t mean the bank will approve a short sale.</p>
<p>If the owner has the income or other assets the bank will not allow a short sale. That&#8217;s not an absolute however. If the owner falls behind in the payments and notifies the bank that they are going to let the property go into foreclosure the lender will sometimes allow the short sale.</p>
<p>Even though some do eventually close they are not that great of a bargain. I recently closed a bank foreclosure sale currently have 2 bank foreclosures in escrow. The sale that closed countered our offer in 2 days and we put the sale together in 4 days. It closed in 30 days and my client is extremely happy.</p>
<p>The two sales that are in escrow went together as easily and will close soon. All three of these bank foreclosures sales will have been put on the market, sold and closed before the previously mentioned transactions will close. Bank foreclosures are better buys and you know you have purchased a home when the bank signs the offer. They want to sell their foreclosures. In fact they have to sell them.&#8221;</p>
<p>Things have now changed. Some lenders are asking owners who are in a foreclosure situation to sell their house on a short sale. My partner Matt is now working with Wells Fargo to sell a home, at their request, in a short sale position.</p>

<p>Bend Oregon real estate is probably one of the best investments you can make in your lifetime. Bend is one of the most desirable places to live in the United States. There are many kinds of real estate in Bend that are good investments. Below are just a few.</p>
<p>Luxury Homes &#8211; Bend has its share of luxury homes. Awbrey Butte, Broken Top, Pronghorn,<span id="more-245"></span> down town Bend and homes on residential acreage hold a large portion of Bend&#8217;s luxury homes. To be considered a luxury home the home must have solid counter tops, commercial grade appliances, have a triple car garage or larger and have top quality finishes through out. The lot should also be at least a quarter acre or more with some seclusion or privacy.</p>
<p>As Bend continues to grow, more and more luxury homes are being built. Bend is becoming known for its skiing, relatively mild weather (four seasons), fishing, golfing and many other activities. Bend will continue to grow and the demand for luxury homes will increase in the coming years. Compared to other parts of the country Bend has some real bargains on Luxury Homes.</p>
<p>Horse Properties &#8211; Bend is also horse country. Since Bend is in the high desert horse properties here should have irrigation rights in order to have pasture. Many buyers that ride frequently prefer to be able to ride out the gate on their property and hit the trails on state land, National Forest land or Bureau of Land Management land. If not, most horse property in Bend is a short trailer ride away to some outstanding riding.</p>
<p>Horse set ups in Bend start around $400,000 and go up to the multi-million dollar range. There is usually a good variety of horse property available for sale in Bend at any given time. The Tumalo area in NW Bend has some very premium horse set ups. There are also some extremely nice properties in the upper price range in the Sisters, Oregon area. Sisters is only 15 miles West of Bend.</p>
<p>River Front Homes &#8211; Water front homes are rare in Bend and bring a premium price when available. There are no lakes in Bend with private property on the water. There is only the Deschutes River which runs from South to North through the heart of Bend.</p>
<p>River front homes in downtown Bend sell at a premium. The Deschutes River in downtown is called Mirror Pond. Prices on nice homes on Mirror Pond start around $1,000,000 and go up. If you are lucky enough to own a home on Mirror Pond you can walk to all of the activities downtown. The downtown area has a multitude of activities year round.</p>
<p>Retirement Homes &#8211; Maybe these should be called homes to retire in so not to be confused with homes for the elderly with 24 hour care. There are many quality commercial retirement homes in Bend but that is not the topic of this article.</p>
<p>Retirees from all over the United States are moving to Bend. The weather, golfing, fishing, hiking, kayaking, medical facilities, art community, festivals, camping etc. are a huge draw to retirees. Redmond Oregon which is 16 miles north has an International Airport which makes travel to and from Bend easy.</p>
<p>There are homes for sale in any price range for all retirees thinking of moving to Bend. Single level homes with 3 bedrooms, 2 baths and a double car garage can be purchased for less than $200,000. There are also gated communities (golf course) for those looking for the privacy of these neighborhoods.</p>
<p>To date however there is only one 55 and older community with homes for sale. These homes are in the lower price range. No matter how you look at it, Bend Oregon is a great place to retire.</p>
<p>Golf Course Homes &#8211; Bend has several golf course communities with homes on and away from the course. Awbrey Glen, River&#8217;s Edge, Mountain High, Widgi Creek, Broken Top, Lost Tracks and Pronghorn are some of the main golf course communities in Bend.</p>
<p>Bend&#8217;s golf course community home prices start around $400,000 and go up to the multi-million dollar range. All of these communities are beautiful places to live in the high desert.</p>
<p>Great Neighborhoods &#8211; Bend is full of great neighborhoods in all sections of the city! NW, SW, NE and SE all have nice neighborhoods! The &#8220;West side&#8221; is very popular but also the most expensive. There is a perfect neighborhood in Bend that is just what you are looking for.</p>
<p>Bend Oregon Real Estate &#8211; No matter what kind of property you buy in Bend it will be a good investment. Bend has its&#8217; market fluctuations like the rest of the nation but will continue to be one of the most desirable places in the United State to live that gives you a high return on your investment.</p>

<p>I own a home in Oregon appraised at $378,000. It&#039;s paid in full. We want to relocate to Raleigh, NC. On a recent trip we made a offer on a home and it was accepted, the sale is pending. To purchase this home I am planing to use the equity in my paid-off home, pay cash for the new home of $230,000, then sale my home in Oregon and therefore the loan would be cleared. </p>
<p>Any better options for doing this? My payments will be about $1900 on the equity loan and I would sure like to avoid having to pay more then one payment. Can i request my payments to be delayed for 90 days? What is the maximum? I wish to sell my old home before having to make those huge payments. </p>

<p>Tigard, Oregon is located approximately 10 miles southwest of downtown Portland.</p>

<p>Portland is the second largest American city in the Pacific Northwest. Real estate markets have been sluggish here but Portland Foreclosures are on the rise.</p>
<p>Portland is situated in Multnomah County, in the state of Oregon. It is a leading exporter of wheat and is an important port in the Pacific North-west for ocean born trade. It is Oregon&#8217;s largest city and set up in 1851 in a &#8216;clearing&#8217; midway between Oregon city and Vancouver.</p>
<p>Real estate in Portland has been in a crisis in 2009 as nearly 18-20 % of Portland homes are being put up for distress sales. Nearly 18% of active listings are being put up for distress sale- amounting to over 2,600 homes across Portland. Of these 14% are up for short sales and 4% are already foreclosed and returned to their banks. The worst affected regions are Gresham, Beaverton, and Happy Valley where a quarter of homes are foreclosed are on their way. As a whole real estate activity in Portland moved at a sluggish pace last month. Although numbers of sales and pending properties are up by 6%, these figures are less than the seasonal average. Prices are down by 17%-18% below the peak.</p>
<p>If we look at some statistics state wise, the larger picture will be clear-</p>
<p>o	For the state of Oregon as a whole, foreclosure filings in April 2009 registered a  13 % increase from March and 127% times that reported in April, last year<br />
<br />o	 Oregon got the 18th ranking in the country for total foreclosure filed properties in April.<br />
<br />o	 One in every 419 Oregon homes was slammed with a foreclosure filing in the month.<br />
<br />o	 Multnomah County was leading in the state with 660 properties listed for foreclosure.</p>
<p>Portland Foreclosures were the result of rising delinquent mortgage payments by house owners. The reason could be the rising unemployment. A second reason could be defaulting by homeowners who had purchased these properties during the housing boom intending to make a profit but could not ultimately fulfill mortgage commitments.</p>
<p>Foreclosures are a wise investment for those interested in making a profit in the real estate business. Banks and owners are ready to sell fast and at cheap rates. Portland is a highly developed, commercial area with good returns on real estate. The increase in Portland Foreclosures must present an opportunity for investors to make a wise purchase</p>

<p>I bought a second home in 2006 out of the city of my first/primary resident at the time.  I lived in my second home and called it my primary resident for two years.  After the two years, I moved back to my first home and rented my second home for 2 years.  So the tennant moved out, my second home is underwater by 250000, so I want to do a short sale.  Can you short sale on a second home, which I lived in for 2 years as a primary resident from the years 2006-2008?  A Realtor told me to contact an attorney regarding this, but attorneys cost money.  Any help is appreciated.</p>

<hr /><b>Can contractor in Oregon foreclose on house for $6k mechanic&#039;s lien, and if so, who else gets paid after sale?</b>
<p>My husband&#039;s mom (Mother In Law, &#8220;MIL&#8221; from here forward) lives in Oregon and owns two houses currently. She has recently become disabled in the last couple years, losing her income ability, and has pretty much no money left at this point. My husband, in an effort to expedite repairs due to fire damage to one of her houses, signed his name to the Heating &#038; Air contract (9 months ago), because he knew that due to her bad credit she would not be approved for an account with the countractor. MIL did not pay the final bill, now contractor has filed a lien against the house, stating that if full amount isn&#039;t paid in 31 days, they will seek court action to foreclose. In the last year, MIL has also had to borrow $40K from us to prevent both houses from being foreclosed on by mortgage company multiple times. We have been advised to file second trust deeds or promissory notes on each of the houses for what she owes us. My questions are:</p>
<p>1. Can the contractor actually foreclose on the house for a mechanic&#039;s lien, according to Oregon law?<br />
2. If they do foreclose, and it is sold at auction, who gets paid? Just them and the mortgage company? What about any other outstanding liens on the property?<br />
3. We have not filed a second trust deed or promissory note on this property yet for what she owes us, is it too late? If the house goes to auction, are they required to set the minimum bid at a price that will satisfy ALL obligations on the property ($60k mortgage + $16k mechanic&#039;s lien [including added attorney&#039;s fees] + $40k second trust deed/ promissory note for us), or just the mortgage and the mechanic&#039;s lien, since the contractor is first in line (filed their lien) after the mortgage company, and before us?<br />
4. How &#8220;on the hook&#8221; is my husband for this debt, since his name was on contract, and his ss# was on credit app., but he doesn&#039;t have any ownership of that property at all?<br />
5. Also, they mailed the notice of lien to my husband at our home here in CA. If we are renting this home, is there any risk that they will try to lien this property, since his name is on the contract, even though we don&#039;t own this house?</p>

PORTLAND, Ore. &#8211; Oregon seems tailor-made for Barack Obama. </p>
<p>
The Democratic voters are considered progressive, post-partisan and reform-minded. Every member of the state&#39;s Democratic congressional delegation voted against authorizing the use of force in Iraq. It&#39;s one of the least diverse states in the country, but not one where race generally comes into play in politics, said Mark Wiener, a Portland-based Democratic political consultant. </p>
<p>
And Oregon never turned out overwhelmingly for former President Bill Clinton, who won the state with 43 percent of the vote in 1992 and 49 percent in 1996. </p>
<p>
&#8220;Oregonians seem to like the cool, cerebral type,&#8221; Oregon pollster Tim Hibbitts said. &#8220;They liked Harding. They liked McCarthy. They liked McGovern. They seem to like that kind of Democrat. And, without putting an ideological implication on it, I think that Obama stylistically appeals to Oregonians.&#8221; </p>
<p>
All of this portends a strong showing for Obama in Tuesday&#39;s mail-in primary. A better-than-expected performance for Hillary Rodham Clinton would do wonders for her campaign, but few, if any, Oregon political experts predict such an outcome. </p>
<p>
Here is what Oregon political strategists and experts will be watching Tuesday:</p>
<p>How quickly is the race called? Good news for the East Coast-based TV networks: Oregon, already three hours behind on Pacific Standard Time, isn&#39;t expected to take long to count the mail-in ballots because of their electronic tabulating machines. </p>
<p>
The ballot counting begins in the morning and the first unofficial results are released at 8:00 pm local time. They will continue to be updated until all the ballots have been counted. According to the Secretary of State&#39;s office, 727,527 ballots had been returned through Sunday. </p>
<p>
Be careful not to read too much into the early tabulations, which are likely to heavily favor Obama because they will come out of Portland and Multnomah County, said Paul Gronke, a Reed College political science professor. </p>
<p>
The showing in the strongholds. Heavy voting in Portland and surrounding Multnomah County are a good sign for Obama. He is expected to beat Clinton by a 2-to-1 margin in this metropolitan area &#8220;full of young Democrats under the age of 35,&#8221; said William Lunch, a political analyst with Oregon State University. </p>
<p>
Clinton needs to perform well in southern Oregon and east of the Cascade Mountains &#8211; areas that are considered more rural and conservative. Following the strategy followed in other states, that&#39;s where Clinton sent her husband to campaign. Look to Bend&#39;s Deschutes County, Medford&#39;s Jackson County and Pendleton&#39;s Umatilla County, experts said. </p>
<p>
&#8220;If [Obama is] winning all of those, he&#39;s going to roll up a big margin,&#8221; Hibbitts said.</p>
<p>
How goes Marion County? The county, which is home to more than 300,000 residents and the state capitol of Salem, has yielded votes within 5 percentage points of the actual statewide primary results in 1988 and 2000 &#8211; the last elections with no incumbent president on the ballot. There is a mix of income levels in the area, from upscale liberals to blue collar workers. </p>
<p>
Clinton needs to win this county by almost double digits if she has any hope of taking the state, said Lunch. </p>
<p>Follow the demography. Political observers expect women to comprise as much as 58 percent of the statewide vote. That would appear to be a promising sign for Clinton, but polls in Oregon have shown Obama leading among women voters. </p>
<p>
West of Portland, Washington County will be a good gauge of suburban female voters. If Clinton has strength in the state other than in rural and small-town areas, she could find it in this county, said Wiener. </p>
<p>
To test Obama&#39;s support among blue-collar Democrats, look to heavily industrialized Albany in Linn County about 70 miles south of Portland, Hibbitts said. </p>
<p>
Obama should do well in the blue-collar counties &#8220;relative to Ohio and Pennsylvania,&#8221; Hibbitts said. &#8220;I&#39;m not saying he&#39;s going to win those counties, but I think he may win some of them. He may win a significant number. And he won&#39;t get beat 3-to-1 the way he did in Pennsylvania in some of those counties. Here, I think he&#39;ll be very competitive, even in the places that he might lose.&#8221; </p>
<p>For a glimpse at the Hispanic vote, look to Woodburn in Marion County, where half of the 20,000 residents are Latino. Good advance work led Obama to eat lunch at a local Mexican restaurant there earlier this month. </p>
<p>To measure college activity, keep an eye on Corvallis in Benton County. Home to Oregon State University and high-tech workers at the major employer, Hewlett Packard, Obama should win the area by a 2-1 margin, Lunch said. </p>
<p>What&#39;s the turnout? With the presidential primary and closely contested Democratic primaries for U.S. Senate (the seat held by Republican Gordon Smith), attorney general and secretary of state, experts are predicting a &#8220;turnout&#8221; of 60 percent or more. In Oregon, which conducts elections by mail, the measure of turnout is actually the percentage of ballots returned. </p>
<p>&#8220;I think we&#39;re going to have the highest Democratic primary here that we&#39;ve had probably in 40 years and that was the Kennedy-McCarthy primary in &#39;68,&#8221; Hibbitts said, &#8220;and that was really the last time Oregon actually mattered in presidential politics.&#8221;</p>
